Article 66 of the Emergency Response Law stipulates: "If a unit or individual violates the provisions of this law, refuses to obey the decisions and orders issued by the local people’s government and its relevant departments, or fails to cooperate with the measures taken according to law, which constitutes a violation of public security management, the public security organ shall punish it according to law."
Article 50 of the Law on Public Security Administration Punishment stipulates: "Anyone who commits one of the following acts shall be given a warning or fined not more than 200 yuan; If the circumstances are serious, he shall be detained for not less than five days but not more than ten days, and may also be fined not more than 500 yuan: (1) refusing to carry out the decisions and orders issued by the people’s government according to law in case of emergency; (two) hinder the staff of state organs to perform their duties according to law; ……”
The first paragraph of Article 277 of the Criminal Law stipulates: "Whoever obstructs state functionaries from performing their duties according to law by violence or threats shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine." The third paragraph stipulates: "In natural disasters and emergencies, those who obstruct the Red Cross staff from performing their duties according to law by violence or threats shall be punished in accordance with the provisions of the first paragraph."
The first paragraph of Article 330 of the Criminal Law stipulates: "Whoever violates the provisions of the Law on the Prevention and Control of Infectious Diseases in any of the following circumstances and causes the spread of Class A infectious diseases or is in serious danger of spreading, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the consequences are especially serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years: …… (4) refusing to implement the prevention and control measures proposed by the health and epidemic prevention institutions in accordance with the Law on the Prevention and Control of Infectious Diseases. "
